In what order is the temporary disability benefit calculated: based on the standard salary (without allowances and increases) or based on the average earnings saved during the study leave?

Should they be limited in size?

Recall that in a situation where the billing period is less than 30 calendar days, the employee's allowance is calculated according to one of the following options (more beneficial for the employee)<5> :

- based tariff rate (salary) (without allowances and raises) of the employee, established on the first day of release from work according to the sick leave;

- based average earnings saved during labor and social (in connection with training) leave, maternity leave, temporary disability.

In the situation under consideration, the amount of the benefit, if calculated on the basis of the average daily wage rate of the employee, which amounted to 63.33 rubles, will certainly be significantly lower than the amount of the benefit calculated on the basis of the average daily retained earnings, which amounted to 120 rubles. Accordingly, it will be more beneficial for the employee to assign benefits based on the average daily earnings.

Note that from 03/24/2017 the average daily retained earnings for the purpose of calculating benefits limited the amount of the average daily maximum amount of payments, on which insurance premiums are calculated for the employee, in the month in which the right to benefits arises<6> .

Let us calculate the value of this constraint for the given situation.

Thus, the maximum amount of payments for which insurance premiums are calculated for an employee of an organization - an HTP resident who enjoys benefits for paying insurance premiums - is one SZPR for the month preceding the month for which these premiums are paid. The size of the average daily retained earnings (120 rubles) exceeds the size of the established limit (120>25.69). The employee submitted a sick leave due to a general illness for the period from 05/03/2017 to 05/05/2017. In the billing period (from 11/01/2016 to 04/30/2017) the employee:

— from 01/09/2017 to 01/13/2017 was in business trip;

- 02/22/2017 was absent from work. In justification, he presented a certificate from a doctor about a planned medical examination (sick leave was not issued);

— from 03/06/2017 to 03/07/2017 was on leave without pay for family and domestic reasons<9> .

The remaining days of the billing period are worked out by the employee according to the schedule of the five-day working week in full.

According to personal account The employee was awarded:

- in November and December 2016 and in January 2017 - 200 rubles each;

- February and March 2017 - 180 rubles each;

- April 2017 - 200 rubles.

In what order are bonuses taken into account when calculating the average daily earnings for the appointment of temporary disability benefits?

By general rule bonuses (with the exception of those of a one-time nature) are included in earnings for the month in which they fall according to the personal account. The procedure for including bonuses in earnings for calculating temporary disability benefits depends on the time actually worked in the month of their accrual. So, if the month is fully worked out, bonuses are taken into account in the accrued (full) amount .

Proportional to hours worked premiums are taken into account in the month of the billing period in which two conditions are met simultaneously:

- not all working days are worked out according to the work schedule;

- from the number of calendar days of this month, calendar days of release from work, namely labor and social leave, temporary disability, downtime through no fault of the employee and release from work in accordance with the law in other cases are excluded<10> .

In our situation, in all months of the billing period (from 11/01/2016 to 04/30/2017), the employee was paid a bonus. In three of them - in January, February and March 2017 - the employee did not work all the working days according to the work schedule.

Let us consider in which of them the second condition is observed.

In January (from January 9 to January 13), the employee was on a business trip . In other words, he was performing the job assignment of the employer, i.e. worked<11>. Therefore these days are not excluded .

In February (February 22), the employee was absent from work in connection with a visit to the doctor . A certificate from a doctor about a planned medical examination is not a document certifying temporary disability. In this regard, February 22 of the calendar days of the month not excluded <12> .

In March (from March 6 to March 7), the employee was provided unpaid leave for family reasons . This is a social vacation, which means that from the number of calendar days in March, the 6th and 7th should be excluded <13> .

Thus, both conditions are met in March. Consequently, the March bonus, when calculating benefits, is taken into account in proportion to the days worked, i.e. in the amount of 163.64 rubles. (180 rubles / 22 days (working days according to the schedule) x 20 days (actual days worked)). The premium for all other months of the billing period (including January and February) is taken into account in the accrued (full) amount.

Payment for temporary disability

Citizens who are covered by state social insurance are entitled to temporary disability benefits. An allowance for temporary disability is granted on the following grounds:

  • illness or injury;
  • caring for a sick family member, including a sick child under the age of 14 (a disabled child under the age of 18);
  • caring for a child under the age of 3 and a disabled child under the age of 18 in case of illness of the mother (another person actually caring for the child);
  • caring for a disabled child under the age of 18 in the case of his sanatorium treatment, medical rehabilitation;
  • prosthetics;
  • quarantine;
  • maternity leave, as well as adoption (guardianship) of a child under the age of 3 years.

Employers are required to pay sick leave to employees based on a medical report.

Temporary disability benefit is assigned for the entire period of temporary disability until the day of its restoration (or establishment of disability), but not more than 120 calendar days continuously or not more than 150 calendar days with interruptions over the last 12 months in case of repeated cases of temporary disability due to with one or related diseases or injury (in connection with tuberculosis - no more than 180 calendar days continuously or 240 calendar days with breaks over the last 12 months).

The allowance for temporary disability is assigned in the amount of:

  • for the first 12 calendar days of incapacity for work - 80% of the average daily earnings;
  • for subsequent calendar days of temporary disability - 100% of the average daily earnings.

The amount of average daily earnings is determined for 6 calendar months preceding the month in which the right to benefits arose.

The minimum amount of benefits per month is set at 50% of the highest budget amount living wage. The subsistence minimum budget from 08/01/2019 to 10/31/2019 is 230.91 Belarusian rubles. Period

Temporary disability benefit is assigned in the amount of 80% of the average daily earnings for the first 12 calendar days of disability and in the amount of 100% - for subsequent calendar days of continuous temporary disability.

The allowance is assigned in the amount of 100% of the average daily earnings for all calendar days certified by a certificate of incapacity for work:

  • invalids and participants of the Great Patriotic War, disabled combatants on the territory of other states;
  • participants in the liquidation of the consequences of the Chernobyl disaster, other radiation accidents, citizens who fell ill and suffered radiation sickness, disabled people due to the Chernobyl disaster, other radiation accidents, citizens who were evacuated, resettled, who independently left the territory of radioactive contamination from the evacuation (exclusion) zone, priority zone resettlement and zones of subsequent resettlement (including children who were in the prenatal state), with the exception of those who arrived in these zones after January 1, 1990;
  • donors who donated blood (men - at least four donations, women - at least three donations) and its components (at least 14 donations) within 12 months preceding the day of the onset of temporary disability (regardless of the reason for its onset);
  • donors - for the period of temporary disability that occurred in connection with the sampling of their organs;
  • persons caring for a sick child under 14 years of age outpatient settings and for a sick child under 14 years old (a disabled child under the age of 18 years) in a hospital, for a child under 3 years old and a disabled child under 18 years old - in case of illness of the mother or other person actually caring for the child, as well as for a disabled child under 18 in the case of his sanatorium treatment, medical rehabilitation.

The allowance is assigned in the amount of 50% in the following cases:

  • diseases or injuries caused by the consumption of alcohol or other intoxicating substances, while no benefit is awarded for the first 6 calendar days of temporary disability;
  • the onset of temporary disability during the period of absenteeism without a good reason.

Maximum period: the benefit in case of illness or injury is granted for the entire period of temporary disability until the day of its restoration or disability, but not more than 120 calendar days continuously or not more than 150 calendar days with interruptions over the last 12 months, and due to with tuberculosis disease - for no more than 180 calendar days continuously or no more than 240 calendar days with interruptions over the last 12 months.

The salary

To calculate the amount of sick leave, the average daily earnings of an employee are taken. Its amount is determined for 6 calendar months preceding the month in which the right to benefits arose. Earnings include types of remuneration (with the exception of payments of a one-time nature), which are subject to mandatory insurance premiums. That is, your income for 6 months is taken and divided by the number of calendar days of this period. Then the resulting value is multiplied by the number of days during which you were sick (confirmed by a certificate of incapacity for work). The amount received is issued in the amount of 80% if you have been ill for less than 12 days. The number of calendar days of the billing period into which earnings are divided does not include periods of labor and social leave; temporary disability; downtime through no fault of the employee; exemption from work in accordance with the law in other cases.

Example: the employee submitted a certificate of incapacity for work due to a general illness, issued from 12 to 15 September 2016 (4 calendar days).

The settlement period for calculating temporary disability benefits is from March 1 to August 31, 2016 (6 months).

The employee's salary for the billing period was:

  • for March (31 calendar days) - 620 rubles;
  • for April (12 calendar days, since 18 calendar days - labor leave) - 310 rubles;
  • for May (31 calendar days) - 620 rubles;
  • for June (30 calendar days) - 618 rubles;
  • for July (31 calendar days) - 620 rubles;
  • for August (31 calendar days) - 620 rubles.

The total income of the employee for six months amounted to 3408 rubles. The number of calendar days is 166.

The average daily earnings for calculating temporary disability benefits for an employee will be 20.53 rubles. (3408 rubles / 166 calendar days). The amount of temporary disability benefits will be 65.70 rubles. (20.53 rubles x 0.8 x 4 days).

But! The size of the hospital has a "ceiling": maximum size allowance is set at three times the average wages workers in the republic. For example, in August it was 745.80 rubles. Consequently, the maximum that can be obtained for a month of illness during this period is 2237.4 rubles. Even if a person’s salary is higher, he will still receive “cut” sick leave payments.

Benefits to persons for whom or for whom mandatory social insurance contributions were paid less than 6 months before the right to benefits arise, are assigned in the minimum amount: per month - 50% of the highest subsistence minimum budget (today it is 193 rubles 58 kopecks) per capita average approved by the Council of Ministers for the last two quarters relative to every 7th month in which temporary disability occurred.
