Residential complex "On Okhta (former Okhta-Modern)"- one of the most famous problematic construction projects in St. Petersburg. Scandalous long-term construction since 2004.

Initially, the Okhta-Modern complex was announced and consisted of 5 buildings with 9 floors each - C1, C2, C15, C16, C17. At the same time, a criminal case was initiated on the fact of fraud on an especially large scale, the victims are the shareholders of Okhta Modern.

However, the situation is complicated by the fact that Smolny, another creditor of Piter-Construction, is trying to terminate the lease and return the site to the city, which is contrary to the interests of both equity holders and the subcontractor.

Back in March, it became known that after a year of negotiations, LSR Group agreed to take on the completion of the long-term construction, which began to be erected back in 2004. Beglov repeated similar information at a meeting with future tenants on June 10th.

However, equity holders drew the attention of the city administration that the problems would not end with the commissioning of buildings. According to their representative Natalya Koroleva, a lawyer by education and a relative of one of the buyers of housing in long-term construction, about 30 apartments are “burdened” with double sales. The victims are worried about the obvious question: when it comes to the issuance of keys, which of the applicants for the same area will be given a bundle and title documents.

According to Koroleva, buyers learned that there are apartments for which more than one owner claims three years ago. “We learned about them in 2016, when they appeared in court. They have contracts from 15-16 years. That is, at the moment when the office of the Peter-Construction company had already actually left for Finland, headed by Krivtsov Sr. (Sergey Krivtsov is on the wanted list and, presumably, - Approx. ed.)", says the activist. According to her, the arbitration court includes in the register of creditors' claims all citizens who "bring at least some documents confirming any payment related to this construction site."

Recall that the LCD alternately tried to build and complete the construction of the company "IVI-93", after its bankruptcy - "Baltzhilinvest" and "Piter-Construction". The last legal entity is associated with the Modul group of companies, controlled by Sergey and Evgeny Krivtsov (father and son). They are not officially the owners of the developer, however, the investigation. Krivtsov Sr. is in international wanted list, and Evgenia in 2017. According to equity holders, at the end of May 2019, Krivtsov Jr. was released from arrest. The developer itself has been going through bankruptcy proceedings since December 2017.

The bankruptcy trustee of Piter-Construction, Vladimir Poluyanov, in turn, counted only 11 apartments in both buildings that were sold more than once - seven in one building and four in another.

“They really are there, it was established by the court. There are two contenders for each,” he confirmed to Fontanka. According to Poluyanov, in this case, the one on whose contract is worth more early date, no advantage. “Some of the equity holders who apply for apartments, to put it mildly, are close to the former management. There are such. Of course, they can write any date. And they will be ahead of the very first. It's impossible to check it out. Therefore, we hope that after all the requirements of equity holders are considered, there will be several apartments for which no one claims,” says the manager.

As of February 2019, there were 18 such apartments in both residential complex buildings. Poluyanov noted that the figure could still change. But it is precisely at the expense of these assets that he hopes to resolve "controversial" situations.

“When all the claims of creditors are considered, the question of resolving disagreements between equity holders will be raised before the court. We will offer an option to transfer to one of the equity holders an apartment that no one claims, and to another - the one for which he initially paid, ”explains Vladimir Poluyanov. The alternative is worse, the manager admits. The negative scenario involves the sale of the disputed apartment and the distribution of money between applicants.

According to Smolny, 476 contracts have now been concluded equity participation in LCD. There are 482 apartments in it.

In addition, according to Koroleva, there are six more equity holders who are threatened with the possibility of being left without compensation and without apartments. These are home buyers on the ground floor, their real estate, along with the change in the design of the house, has turned into commercial - that is, non-residential premises.

The "transformation" of the first floor took place when Piter-Construction agreed on its first project in 2014 and received a building permit. “Initially, according to the project, these were apartments. Under the law, owners of contracts for the acquisition of commercial premises do not enjoy the same protection as equity holders. They will have to wait in general queue creditors. According to the Construction Committee, the readiness of the facility is 80%. Impressive, considering that the residential complex has been built since 2003. The building permit was renewed at the beginning of April. According to the committee, LSR undertook to put the residential complex into operation in December of this year. Whether it will succeed or not, we will not guess. Judging by the messages of equity holders in the Vkontakte group, there is no particular activity at the construction site yet. However, perhaps this is due to the fact that the main work is going on inside. LSR Group does not comment on the situation with this object, there is no information on it on the official website of the company.

Currently for potential buyers this project of little interest, since sales in it are closed. You can, of course, consider it as a purchase option on the market secondary housing, but will have to wait for the commissioning of the residential complex. In the ranking of new buildings in Bolshaya and Malaya Okhta, this residential complex is in last place for obvious reasons. The nearest alternatives on the right bank of the Neva are the already commissioned Platinum residential complexes (developer rating “C”), the Four Horizons residential complex from RBI (rating “A+”), the residential complex “Five Stars” (rating “B+”) . They also noted all the pros and cons of this facility under construction. It makes no sense to repeat all this, there are no new factors with a plus or minus sign. To be honest, a year ago it was thought that 2016 would be the final year of this “fascinating epic”, and the equity holders would finally get their apartments. However, the story continues.

Let's say right away that we are not going to throw a stone at the company's garden. This structure, quite respected in the market, joined the project at an intermediate stage, when the city authorities were looking for a way to solve the problem of this long-term construction. "Construction Department" marked with a score of "B +" in the expert and works very stably, having a lot of handed over residential complexes. The work performed by the company in the Na Okhta residential complex (where it acts as a general contractor and investor) can also be assessed positively. In fact, as of the beginning of January 2017, the residential complex is in a high stage of readiness. Why didn't it manage to be handed over at the end of last year, as planned? The company does not comment on this situation. However, business media, citing the St. Petersburg Construction Committee, report that the reason is the financial insolvency of the developer, the Peter Construction company. This company owes the "Construction Department" about 200 million rubles (and according to some reports even more), in addition, it has multimillion-dollar debts to the city for rent payments. As a result, it was not possible to complete the work on the residential complex "On Okhta" on time. And it is not yet clear whether it will be possible to hand over the object in the first quarter current year. On the official website of the general contractor, the Construction Department, the deadline for completion is the fourth quarter of 2017 (the building permit, by the way, has been extended until December 31 of this year).

It is known that the residential complex "On Okhta" for the company "Peter Construction" was in conjunction with another project -. The city transferred to the developer the rights to build on Primorskaya under the obligation to complete the long-term construction on Okhta. However, the company did not have funds for both objects. Now it is reported that Piter-construction, with the assistance of the City Construction Committee, is looking for an investor for the construction of the Bering Towers. The sale of apartments in this complex should provide the necessary funds to complete the residential complex "On Okhta". It seems to us that this scheme of development of events is quite real. The year has just begun, the Bering Towers project is very attractive due to its favorable location next to Primorskaya. Finding an investor for this project is real. So there is every reason to hope that the money will come and this year the residential complex "On Okhta" will still be put into operation.

The residential complex is being built in the old part of the Krasnogvardeisky district. There are few spots for building here, so there are few new buildings. Now they are all grouped on the Sverdlovskaya Embankment - next to the Revolution Highway and Piskarevsky Prospekt. Apartments here are offered in already commissioned complexes from (rating "A" in) and from (rating "C"). Under construction also from (rating 'A+') and from (rating 'A'). She began building a residential complex back in 2003, which went bankrupt in 2009. As a result, about 400 deceived equity holders were left without money and apartments. Then ISK Baltzhilinvest tried to complete the residential complex. But also unsuccessfully - in 2013 it became clear that the company was not able to complete the task.

Given the public outcry, the city authorities have taken steps to address this issue. As a result, companies such as (acting as a customer and developer), MODUL LLC (general contractor) and (acting as an investor) are now responsible for completing the construction of a residential complex at Bolsheokhtinsky, 15.

It is clear that these companies have a great responsibility, especially considering that the city administration has announced its intention to fully provide housing for all the deceived equity holders of the Northern capital in the next 2-3 years.

The city media reported that the authorities of St. Petersburg put of the company "Peter-Construction" condition: completion of construction LCD "On Okhta" is mandatory for obtaining a building permit for another facility of the company (). Today it can be judged that a compromise between officials and builders has been reached. As a completion date LCD "On Okhta" determined in the fourth quarter of 2016. As a summary, let's say the following: given the location of the residential complex and the amount of amenities offered by the developer, it is possible to determine this residential complex as suitable for living the most different groups population. Against the background of proximity to the historical part of St. Petersburg, the price looks quite adequate. But considering complex history of this residential complex, we would still recommend that potential buyers of apartments carefully study the proposed contract and all documents with a lawyer in order to eliminate even the slightest risk for the future. The history of each particular apartment should be transparent and completely exclude the possibility of double sales in the past.

The choice on the primary market in this part of the Krasnogvardeisky district is not very wide. As alternative options, one can mention residential complexes, and. Price square meter in all these residential complexes is approximately comparable.

The press service of LSR reported that communication with buyers of apartments in this residential complex is beyond the competence of the company.

LCD "Okhta Modern" on Bolsheokhtinsky Prospekt, 15, was supposed to be completed in 2005. Then the developer was the subsequently bankrupt company IVI-93. In 2009, IVI-93 transferred the rights to complete the construction to Baltzhilinvest LLC, and in 2012 they were transferred to Piter-Construction LLC. For the obligation to complete the construction of the houses, the city administration provided Piter-Construction with three plots at 29 Bering Street, where the company was going to build the Bering Towers multifunctional complex. In May of this year, Piter-Construction LLC was declared bankrupt, and in June its CEO Timofey Pozdnyakov was sent under house arrest in the case of double sales of apartments in the unfinished Okhta Modern residential complex.

On this moment the residential complex is built on 80%. At the same time, all the apartments in it were sold, and at least 50 of them were sold twice. From fraud construction companies more than 400 people were injured.

According to the arbitration manager of the Piter-Construction company, LSR plans to complete the construction of Okhta Modern at its own expense and has already provided it with an estimate and reported the cost - 830 million rubles. According to Vladimir Poluyanov, the specified price raises doubts. Earlier, according to the conclusions of the LenSpetsSMU company, the cost of completing the facility was estimated at 400-600 million rubles. The LSR press service, commenting on the issue of the difference, said: "The assessment of the cost of work on the project is not carried out by us, but by the relevant expert organizations." Mr. Poluyanov believes that the amount was overstated in order to receive equivalent preferences from the city authorities.

At the time of the release of the note, the construction committee and the governor's press service could not provide comments on how the situation with the problematic object would be resolved and what preferences LSR could count on for having assumed obligations to complete the construction of the residential complex.

The arbitration manager sees the solution to the long-term construction problem in public auctions, for which three sites on Bering Street can be put up: their bankrupt company Peter Construction received from the city administration, undertaking to complete the construction of the houses of the Okhta Modern residential complex. If this property is sold at an open auction, the money will be received by equity holders, creditors, and the city budget. "I am perplexed by the position of the city authorities, who are abandoning a transparent and understandable plan for the implementation of tenancy rights land plots to Bering and payment from the funds received for the cost of completing the construction of the Okhta Modern residential complex, as well as compensation for debt rent KIO in the amount of 150 million rubles and solving problems with double sales. Instead, the construction committee is consistently implementing a plan to seize land plots on Bering Street and is looking for an opportunity to compensate LSR's costs in some kind of behind-the-scenes way," said Vladimir Poluyanov.

The commissioning of the long-suffering long-term construction project "Na Okhta" (former name - "Okhta-modern"), the path to completion of which seemed to have been clearly defined at the beginning of this year, is again under threat. This time, the former general contractor, whose work has already damaged the project, is preventing the satisfaction of the legal requirements of the deceived equity holders.

Recall that on February 27, 2018, with the active participation of the Government of St. Petersburg, a memorandum of cooperation was signed between OOO LSR . Real Estate - North-West" ("LSR Group"), acting as general contractor, Piter-Construction LLC - the developer (since December 2017 in bankruptcy proceedings) and temporary manager Vladimir Poluyanov.

Already on March 2, a field meeting was held at the construction site of the complex, the participants of which spoke about the prepared step by step plan, the implementation of which would allow to complete the construction of long-term construction by the end of the year. According to preliminary estimates, the construction readiness of the facility is about 80%. Completed the entire construct, most of the facades and partitions. According to approximate estimates, about 300 million rubles are needed to complete the construction of the facility. Moreover, LSR Group expressed its readiness to finance the work. As a result, 326 affected equity holders would finally receive their apartments, which they have been waiting for since 2006.

At the moment, as planned, a survey of the structure of the long-term construction has been completed, a project has been prepared for the implementation of the work necessary for the full completion of the facility. The reputation of one of the leading developers in the country seemed to be a sufficient guarantee of a successful solution to the problem.

However, on the way practical implementation plan encountered unforeseen difficulties. Insolvency practitioner Vladimir Poluyanov did not sign an agreement with LSR Group, referring to the need for a decision of the creditors' meeting. The main creditor of LLC "Piter-Construction" is LLC " Construction Management”, which was the general contractor that carried out the construction of two unfinished houses, and which today has 70% of the votes of all available creditors. While 326 equity holders, who have been waiting for their apartments for more than a decade, ended up in minority shareholders.

The next meeting of creditors took place on June 13. As a result, an agreement with LSR Group was finally signed, but not in such a form that would allow full continuation of work on the completion of the facility. The agreement reflects the already completed work on the inspection of the building, adjustment project documentation etc. Preparatory work is mentioned, some of which has already been done, and some is yet to be carried out.

At the same time, in the version of the agreement prepared by LSR Group, there was a condition on the transfer of the construction site for preparatory work, some of which are included in the number of construction and installation works. The Construction Department, using the right of the majority creditor, despite the unanimous opinion of the deceived equity holders, excluded this provision from the agreement, allowing only visits to the construction site by employees of LSR Group, which can be blocked at any time. And this will entail another delay in the delivery of long-term construction. In order to comply with its obligations to the city, LSR Group agreed to such an edition and signed the agreement, since this document is currently critically needed for submitting the project for examination.

This position of the "Construction Department" causes deep indignation of the deceived equity holders. “This company itself claims to complete the construction of the complex - more precisely, not for the completion itself, but for the opportunity in this way to obtain rights to the site on the street. Bering in the Vasileostrovsky district (Piter-Construction leased this site from the city in order to build an apart-hotel, when it undertook to complete the construction of the Okhta-modern residential complex). The leadership of the "Construction Department" invited representatives of our initiative group to a meeting and suggested that we demand from the city that the object be transferred to them. And this despite the fact that when they worked as a contractor for Peter Construction at our complex, construction work was carried out with terrible violations and disgusting quality. The words of a social activist about the quality of work of the "Construction Department" at the facility find documentary support.
