Restructuring a home mortgage loan is a smart decision that benefits both parties to the transaction. The bank is guaranteed to continue to receive payments, the borrower keeps a “clean” credit history without being included in the list of debtors. The existence of such a service in the banking market justifies itself. It is important not to accumulate debts, but to apply to AHML in a timely manner with a request for state support.

The role of the state

Borrowers in need of government assistance enter into banking organization new mortgage agreement.   • suspension of payments for a certain period;
  • no fees associated with the restructuring procedure;
  • currency changes.

For payers, participation in this program is completely free. The property pledged to the bank must meet the following requirements:

  • not be luxury housing;
  • the area of ​​a one-room apartment is not more than 45 square meters;
  • two-room apartment - no more than 65 square meters;
  • the size of an apartment of three rooms - no more than 85 meters.

An apartment pledged to a bank - a lender, for example, Sberbank - is the only housing of the borrower. If there are three or more children under the age of 18 in the family, the requirements for the area of ​​the premises are irrelevant.

After applying to AHML, the borrower, who has received a positive decision, again applies to the bank, where the parties agree on a restructuring option. The new agreement will allow the citizen to fulfill his obligations under the loan in full, but with a slight delay. The Agency for Housing Mortgage Lending (AHML) will transfer funds to the bank in the amount of the assignment made to the borrower.

Who gets help

Not every citizen can become a member of the state program. The agency imposes a number of requirements on borrowers. Categories of citizens who can apply for participation in the program:

  • combat veterans;
  • large families in which at least one child is a minor;
  • persons with disabilities;
  • parents of children with disabilities or who are themselves such;
  • citizens with at least one minor child and under 35 years of age;
  • citizens who are employees of state authorities, local governments;
  • citizens who are employees of state and municipal institutions, organizations of the military-industrial and research and production complexes.

All program participants must be citizens of the Russian Federation, whose income has recently become lower than confirmed at the time of obtaining a mortgage. Procedure

  • The borrower's mortgage obligations to the bank are reduced in the amount of 20% to 30% of the balance (at the discretion of the lender's bank), but not more than 1,500,000 rubles.
  • By agreement between the borrower and the bank, you can choose the format of assistance, namely, or send the entire amount of assistance to the mortgage to pay off the principal debt and thereby reduce monthly payment, or to reduce the monthly payment by 50% or more for up to 1.5 years.

Who can receive support from the state

Government Decree No. 373, as amended on November 24, 2016, provides for the following list of persons to whom the state can help pay mortgage payments:

  • Citizens of the Russian Federation with 1 or more minor children;
  • Guardians (custodians) of 1 or more minor children;
  • Participants in hostilities;
  • Disabled people or families with disabled children;
  • Citizens with dependent children under 24 who study full-time at an educational institution.

Mortgage requirements

When AHML makes a positive decision, the bank will notify you of the date of the meeting. The normative act provides certain categories of the population with the right to restructure debt.

The support mechanism used has the following characteristics:

  • the duration of the period of assistance to borrowers ranges from 6 months to a year;
  • the lender (bank) has the right to compensation for lost profits or losses from borrowers with a difficult financial situation;
  • the maximum amount of such compensation may not exceed 200 thousand rubles.

Criteria for Borrowers Needing Mortgage Assistance

To receive financial support for a mortgage from the state, the borrower must meet all of the following criteria:

  • persons with minor children (including guardians);
  • citizens with disabilities or having children with disabilities;
  • combatants;
  • persons with dependents under 24 years of age (students, students, graduate students, interns, interns, etc.).

The conditions for entering the program are as follows:

  1. A drop in the current level of income by at least 30% (for any mortgage loans).
  2. The total average monthly income of the borrower and his family members for at least the last 3 months, taking into account the payment of the mandatory mortgage payment, does not exceed twice the subsistence minimum for each (indicators of a particular subject of the Russian Federation are taken for calculation).
  3. An increase in monthly payments under a loan agreement by at least 30% for a foreign currency mortgage.
  4. Registration of a mortgage loan no later than one year before the date of filing an application for state support and assistance.
  5. Participation of the creditor bank in the ongoing Program.
  6. Appeal to the bank with the required set of documents and application.

The amount of debt (including overdue) and the number of participations in the restructuring of the loan do not matter. The interaction between the client and AHML is carried out through the selected agent bank, to which the borrower applies with the appropriate application.

Requirements for a mortgage

The requirements established by law shall apply to the pledge (subject of mortgage) encumbered by the bank under a mortgage agreement. Among them:

  • housing must have the status of the only one for the borrower and his family (the situation is recognized as equivalent when the borrower's family members and he himself have a total share in the ownership of another property, but not more than 50% in each residential property);
  • the residential property must be located on the territory of Russia and be an object of pledge under a mortgage agreement;
  • the program applies to any housing, including objects in relation to which the right to claim under an equity participation agreement applies;
  • there are restrictions on limit values total area of ​​mortgage housing: no more than 45 sq. m for one-room apartments, no more than 65 sq. m. for a house or two-room apartment and up to 85 sq. m. in the presence of three or more rooms;

  • the above restrictions do not apply to families with three or more children.

If an apartment or other property transferred to the bank as collateral meets the listed requirements and restrictions, then the mortgagor has the full right to participate in the state program.

The adopted program implies the use of the following forms of state support:

  • Reducing the amount of regular payments on the loan during the entire period of state assistance to one year.
  • Partial or complete forgiveness of the principal debt or a change in the terms of lending by the bank that issued the loan.
  • Reducing the current interest rate to no more than 11.5% per annum.
  • Change of currency from foreign to Russian rubles (the exchange rate as of the date of conclusion of the restructuring agreement is taken into account).
  • Exemption from payment by the borrower of forfeits, penalties or other fines accrued in accordance with the terms of the loan agreement (except for penalties by court order).

Submission of an application for restructuring is accompanied by the collection of the following set of mandatory documents:

  • statement prescribed form to receive state support, indicating the reasons and necessary conditions for lending;
  • passport of a citizen of the Russian Federation - the borrower, mortgagor and family members (copies of all pages);
  • certificate of income of the client for at least the last 3 months (in the form of 2-NDFL);
  • a copy of the work book or employment contract certified by the employer;
  • title document of the mortgage (copy);
  • a document confirming the assignment of a certain social status to the borrower (birth certificates of children, certificate of disability, certificate of a combat veteran, etc.);
  • application of a citizen and members of his family about the right to housing, which is not an object of pledge.

Confirmation of the uniqueness of housing is not required by documents, since AHML receives the necessary information independently from open sources and databases.

At the same time, each bank and AHML as a whole reserves the legal right to request additional documents, with the help of which it will be possible to carry out the right decision about the feasibility of restructuring the loan.

The practice and feedback of borrowers testify to the fact that you can expect to receive financial assistance from the state can practically only currency mortgages. For other applications, the rejection rate is very high.

The state assistance program presented by AHML was supposed to cease to exist in May 2017, but due to the lack of improvements in the country's economy, the Government of the Russian Federation decided to postpone the state program of AHML. The corresponding Decree was signed by D. A. Medvedev in August 2017.

The essence of the program

The new programs of the AHML agency began to operate on August 22, 2017. The main point is to restructure the loans of debtors left without a livelihood. During the restructuring, the state provides the debtor with 1.5 million rubles, but not more than 30% of the remaining amount of obligations (initially, from 2015 to 2017, the AHML mortgage program implied a return of 20%). These funds are intended to repay part of the mortgage loan and are transferred immediately to the account of the creditor (bank). The borrower does not receive the specified funds on hand. Moreover, the applicant does not interact with the agency at all. He only needs to apply to the bank with an application for restructuring, and then the bank itself will transfer required documents by the address.

Who can apply for government support

First of all, the federal program of the AHML agency was aimed at helping citizens who took out loans in dollars and euros. After the fall of the Russian ruble, such borrowers were forced to pay several times more on the loan than the original amount. But in the process of studying the situation with mortgage lending it became clear that mortgage repayment assistance was also required for those borrowers who took out a loan in Russian rubles, but subsequently found themselves in a difficult situation.
According to paragraph 7 of Government Decree No. 961, AHML should provide an assistance program to the following categories of borrowers:

  • Families with at least one child under the age of 18 in the upbringing (maintenance);
  • Families that have at least one disabled child in their upbringing (maintenance);
  • Families that have a full-time student in their support;
  • Persons with disabilities;
  • Veterans of war (real combat operations).

These categories of citizens can take part in AHML programs only if they meet the following requirements:

Lack of income. To determine the insufficiency, the average monthly official income of all people in the family (borrower, his spouse, children) for the last 3 months is taken into account, and the amount of the monthly loan installment is subtracted from it. If, as a result, for each person in the family (including those who do not have official income) there are not at least 2 living wages adopted in the region, the borrower will fall under the concept of insufficient income.

But since the essence of the AHML state program is to provide assistance to those who find themselves in a difficult financial position, income insufficiency will be recognized as such only if the monthly loan payments have increased by at least 30% of the originally estimated amount.

  • The mortgage was provided for the purchase of housing located within the territory of the Russian Federation.
  • Living space limitation. You can get on the list of the AHML agency program only if total area purchased housing does not exceed the following parameters:

o 45 sq.m. for one-room housing;
o 65 sq.m. for two-room housing;
o 85 sq.m. for housing with 3 or more rooms.

  • An apartment purchased on a mortgage is an uncontested living space for the borrower and his family. According to the AHML assistance project, it is allowed that the borrower or members of his family may own no more than 50% of the share of any residential premises (one for all). Thanks to the interdepartmental system of electronic interaction, the applicant does not have to provide information about the presence (absence) of housing. The agency verifies this information independently.
  • The loan was received at least 1 year ago. The mortgage program of the AHML agency is provided only to those borrowers who received a loan at least 12 months before the date of application. If the borrower has previously completed restructuring, he cannot receive a subsidy until 12 months have passed since the recalculation of the loan.

Separately, the AHML assistance program for residential mortgage indicates that if the borrower does not meet only one or two of the specified requirements, he can receive a state subsidy. At the same time, refusals under the AHML support program are possible even if the citizen meets all the requirements. According to the same AHML mortgage program, the decision to grant subsidies to certain borrowers is made by a specially created mortgage interdepartmental commission.

Conditions for obtaining state support

If the client meets the requirements of AHML, he can be provided with a program of assistance to mortgage borrowers. To do this, he must send an application to the bank for the recalculation of the loan under the AHML program. There is no need to submit a separate application to the agency. The list of applicants will be transferred to the interdepartmental commission by the bank itself. If the borrower was previously denied support under the AHML program, he has the right to send a second application for restructuring. This is especially true in cases where a citizen was refused due to lack of funds from the agency. From March to August 2017, the agency simply did not have the finances to provide subsidies to citizens. When it became known that the program would be extended, another 4 billion rubles were allocated for the project (2 billion from the country's budget and another 2 billion through the issue of new shares of the agency).

The AHML Agency Mortgage Program is subject to the obligatory observance of the following conditions:

  • Transfer of mortgages from dollars (euros or any other currency) to local rubles at the rate of the Central Bank, which was established at the time of approval of the application for restructuring.
  • Setting the interest rate at 11.5%. At the same time, the AHML's Mortgage Assistance Program enables the bank to lower the interest rate even further. The main thing is that it does not exceed 11.5%.
  • Reducing the total amount of debt by 30%, but not more than 1.5 million rubles. According to practice, the AHML agency can provide the Mortgage program in one of the following options:

o one-time write-off of the entire amount of state support with a decrease in the amount of monthly payments;
o transfer of loans from foreign currency to local rubles at a rate lower than the current rate, established by the Bank Russia.

  • Elimination of any penalties and fines accrued on mortgages for late payments. If the penalty is collected by court order, the mortgage borrower assistance program will not be able to help the citizen.

According to the requirements of the state and the agency AHML, the federal program of assistance to mortgage debtors prohibits banks from charging additional commissions from borrowers during loan restructuring. Banks are also prohibited from shortening mortgage repayment terms.

The Borrower Assistance Program has no expiration date. If in the previous version of the project the validity period (2 years) was clearly specified, then the current AHML program is unlimited, most likely it will be extended until the economic situation in the country improves. As long as this project is in operation, new types of AHML programs should not be expected, especially since an amount of 4 billion rubles was allocated to support borrowers who find themselves in a difficult situation.

Legacy projects

Until 2014, several more AHML programs were implemented: "Young Family" and "Moving". These types of AHML programs were adopted in order to create favorable conditions for obtaining a loan for young families with children, and citizens who own residential property, but who want to move to a new building.

Young family

The essence was to provide a reduced loan rate for families with at least one minor child to raise. In this case, one of the parents had to be no older than 35 years. The AHML program provided for the repayment of the difference in the interest rate with the help of a state subsidy.

moving

Another outdated AHML program. It was provided to citizens who own their own housing, but wish to move out of it. There were 3 types of projects:
1. Economy. The borrower sold his apartment, in return for which he received cheaper housing, he could dispose of the remaining funds at his own discretion. The option was relevant in case the borrower could not cope with the current mortgage loan. Then he sold a house (apartment) purchased with a mortgage, and in return received more modest residential property.
2. Intercity. The applicant sold his housing to the agency, moved to another locality and with the proceeds he bought an apartment there. To participate in the project, it was necessary that a citizen get a job in a new city and pass a probationary period there.
3. Comfort. The client sold his house and moved to a new, more expensive one. The option was popular when purchasing housing in new buildings. Then the principal amount shared construction it was necessary to pay immediately, but for this it was necessary to sell your home. The agency allowed citizens to stay in their old house, but at the same time own the area in the new building. As soon as the apartment was completed, the clients moved to new house.
The main disadvantage of this type of loan is a short loan term: from six months to 2 years. In the case of a larger difference between the cost of the old and new housing, the client had to pay large monthly installments.

Mortgage loans continue to be popular despite financial crisis. To facilitate mortgage payments, a special program of assistance to citizens has been developed. In 2019 State Agency for Housing Mortgage Lending continues to make compensations for housing loans.

Amount of state aid

Who is eligible for the subsidy

In addition to having children, the following categories of citizens can exercise the right to partial debt repayment:

  • guardians or adoptive parents of minor children;
  • participants in the war who received the title of veteran;
  • parents with a disabled child;
  • disabled persons of certain categories.

There are a number of life circumstances in which a conscientious borrower may qualify for a refund:

  • the total income of all family members for the last quarter (3 months) decreased by more than 30%;
  • the amount of monthly payments to repay a mortgage loan has increased;
  • after paying off the debt for the personal needs of the family, there are less than 2 subsistence minimums established in the region of residence.

To confirm life circumstances, it is required to submit documents that are carefully checked by the Agency's employees, after which a decision is made to provide assistance to borrowers, or to refuse it.

Don't expect to pay off your debt in full. But pleasant moments in the form of interest rate cuts or partial repayment debt can be a significant support for a family in a difficult financial situation.

All preferential provisions have their own expiration dates, so do not delay collecting required documents if a new direction appears in the program.

The beginning of 2018 brought a tempting offer to provide an additional subsidy, but a huge number of requests from those who wanted to take advantage of this led to a sharp closure of the project, due to the fact that the allocated funds had run out.


Registration procedure

Using the state program is quite simple - you need to provide a standard package of documents to the credit institution that issued the mortgage loan:

  • passport of a citizen of the Russian Federation;
  • full loan agreement for an apartment or house;
  • a certificate from the bank on the maturity of the mortgage and the remaining amount of the debt;
  • income statement from work;
  • confirming the right to ownership of mortgaged housing;
  • an extract from the USRR on the absence of other housing;
  • if there is a co-borrower, his certificate of income;
  • certificate from the pension fund on the lack of income of dependents;
  • certificate from the pension fund on the amount of the pension;
  • agreement about equity participation(for new buildings);
  • valuation of collateral property;
  • certificate from the bank about the payment schedule;

Documentary evidence of material difficulties that have arisen will also be required:

  • certificate of unemployment;
  • certificate of reduction wages at the enterprise, with copies of orders to reduce salaries;
  • all kinds of extracts from hospital cards, if the repayment of the debt is prevented by any diseases.

All documents from the USRR are issued on a fee basis. In case of refusal to provide a subsidy, the money will not be returned. It is worthwhile to study the provisions on the appointment of assistance well in order to avoid waste of money.

In addition to the main types of documents required to be presented in credit institutions additional certificates and extracts may also be required. The term for consideration of the application is standard - 10 working days from the date of submission.

It should be remembered that each individual financial institution reserves the right to set deadlines according to internal regulations. If it is necessary to urgently draw up documents, it is possible to write a written application to the bank with a request to expedite the verification process.

Payment procedure

Partial or full repayment of a mortgage at the expense of the state occurs in several stages:

  1. To avoid wasting public funds not for its intended purpose, the money is transferred to a special account from which repayment is automatically performed.
  2. If a child is born in the family during the conclusion of the contract, the state provides an additional 5% subsidy.
  3. All program participants receive a certificate confirming the status of a beneficiary.
  4. Repayment of the loan under the state program takes place in all banks of the Russian Federation.
  5. Assistance to mortgage holders is provided once.

Basic requirements for housing and borrowers

In order to receive a preferential subsidy, an apartment or house must meet the following requirements:

  1. Borrowed housing should be the only one for the owners.
  2. The cost of an apartment should not be higher than 60% of the cost of similar housing in the region, according to the Federal State Statistics Service.
  3. The areas must not exceed the following dimensions:
  • one-room apartments - 46m²;
  • two-room apartments - 65m²;
  • three-room apartments - 85m².

The rules do not apply to families with 3 or more dependent minor children. It is mandatory for the borrower to have Russian citizenship.

Pros and cons

The pluses include a rather impressive size financial assistance which makes life easier for the borrower. At the same time, the lack of transparency of the procedure, a large list of documents, paid certificates from the State Registers and the lack of explanations in case of refusal make the process of obtaining assistance tedious.

We can safely say that the program is a good support for housing borrowers who find themselves in tight financial circumstances. But the receiving mechanism needs significant improvements. The first of these should be the maximum transparency of all stages of obtaining such necessary assistance to young families.

Note that the main focus of the program is aimed at preventing a demographic crisis in the country. Apart from housing subsidies the state is actively developing social support for families with children, so the funding rules change every year, you need to carefully monitor new bills so as not to miss your chance to take advantage of the benefits.
